NTRCA Act

The Non-Government Teacher's Registration and Certification Authority Act 2005 was passed in the Parliament on 09 February 2005 to ensure that the SMCs and GBs could not appoint any sub-standard person as an assistant teacher or lecturer in a Non-govt. school or college. The youngest statutory body established in the same year according to section 3 of this Act is responsible to ensure quality teachers in 28,000 non-government educational institutions of this developing nation.

According to Section 4 its Headquarters has been located in Dhaka . If need be felt NTRCA's branch offices may be opened in any place of Bangladesh . The administration and management of the body has been vested to an Executive Board as per provision of section 5. Section 6 and 7 enumerate the constitution of the EB and modes and procedures of its meeting respectively. Section 8 describes the functions of the Authority and its jurisdiction is enunciated in Section 9.

The most vital provision of the Act is enumerated in section 10 which has imposed bar on appointment of persons in any non-government educational institutions as teacher unless he/she is registered and certified by the Authority. The Authority is to prepare list of competent teachers for employment as teachers in non-government educational institutions through the manner and mode as determined by the Regulations. However, teachers employed duly in a non-government educational institution allowed to run regular courses before 20 March 2005 and enjoying salary subvention from the government may apply for suitable position in similar institution. Section 11 sets forth provision of appointment of a Chairman and the following section prescribes for appointment of a Secretary and other officers and staff of the body.

Section 13 has bestowed power to form Committees on the NTRCA for efficient discharge of its responsibilities. Sections 14 and 15 enumerate on the Authority's fund and budget respectively. Section 16 enumerates on maintenance of books of accounts and audit. As per the provisions of this section the NTRCA shall maintain appropriate books of accounts and prepare the annual statement of accounts. The Comptroller and Auditor General of Bangladesh is empowered to audit the fund of the Authority every year. Section 17 gives a task on NTRCA Chairman to prepare an annual report ending in December on its works and activities and submit the same to the govt. by 30 March in the following year. The 22-section Act was executed on 20 March 2005.
